Concertation sociale ne publie plus la b<\/em><\/strong>rochure\u00a0<span style=\"color:#0000ff\"><span style=\"color:#000000\">qui vous informait sur les sp\u00e9cificit\u00e9s de ce contrat.\u00a0 Par contre, vous pouvez trouver les informations sur la page <strong><em><a href=\"http:\/\/www.emploi.belgique.be\/defaultTab.aspx?id=41944\" target=\"_blank\">Contrat de travail des \u00e9tudiants du SPF<\/a><\/em><\/strong> sur le site du SPF.<br \/>\n<\/span><\/span><\/p>\n<h2 style=\"text-align:justify\"><span style=\"color:#000080\">Tout d&rsquo;abord, <strong><em>qui sont ces \u00e9tudiants<\/em><\/strong> ?<\/span><\/h2>\n<p style=\"text-align:justify\"><span style=\"color:#0000ff\"><span style=\"color:#000000\"><span style=\"color:#0000ff\"><span style=\"color:#000000\"><!--more-->Le terme n&rsquo;est d\u00e9fini par aucune loi, mais <strong><em>seules sont concern\u00e9es par ce type de contrat les personnes qui<\/em><\/strong> :<\/span><\/span><\/span><\/span><\/p>\n<ul>\n<li>\n<div style=\"text-align:justify\"><span style=\"color:#0000ff\"><span style=\"color:#000000\">ont <strong><em>15 ans et plus<\/em><\/strong> et ne sont <strong><em>plus soumises \u00e0 l&rsquo;obligation scolaire \u00e0 temps plein<\/em><\/strong><\/span><\/span><\/div>\n<\/li>\n<li>\n<div style=\"text-align:justify\"><span style=\"color:#0000ff\"><span style=\"color:#000000\"><span style=\"color:#000000\">qui suivent un enseignement de <strong><em>plein exercice<\/em><\/strong><\/span><\/span><\/span><\/div>\n<\/li>\n<li>\n<div style=\"text-align:justify\"><span style=\"color:#0000ff\"><span style=\"color:#000000\"><span style=\"color:#000000\">qui ch\u00f4mage<\/em><\/strong> (m\u00eame de \u00ab\u00a0transition\u00a0\u00bb)<\/span><\/span><\/span><\/div>\n<\/li>\n<li><span style=\"color:#000000\">de ne travailler <strong><em>que pendant les p\u00e9riodes de vacances<\/em><\/strong><\/span><\/li>\n<\/ul>\n<h2 style=\"text-align:justify\"><span style=\"color:#000080\">Le contrat proprement dit<\/span><\/h2>\n<p style=\"text-align:justify\"><span style=\"color:#0000ff\"><span style=\"color:#000000\"><span style=\"color:#0000ff\"><span style=\"color:#000000\">Le<\/span> <span style=\"color:#000080\"><strong><em>contrat d&rsquo;occupation d&rsquo;\u00e9tudiant<\/em><\/strong><\/span> <span style=\"color:#000000\">(appellation officielle) est un contrat <strong><em>r\u00e9gi par la loi du 3 juillet 1978<\/em><\/strong>, comme tous les <strong><em>contrats de travail<\/em><\/strong>, c&rsquo;est-\u00e0-dire les <strong><em>contrats liant un employeur et un travailleur salari\u00e9<\/em><\/strong>.\u00a0 Mais comme il comporte des <strong><em>\u00e9l\u00e9ments sp\u00e9cifiques propres au seuls \u00e9tudiants<\/em><\/strong>, il doit <strong><em>obligatoirement<\/em><\/strong> \u00eatre conclu par un <strong><em>document \u00e9crit<\/em><\/strong> et doit comporter un <strong><em>certain nombre de mentions\u00a0 :<\/em><\/strong><\/span><\/span><\/span><\/span><\/p>\n<ul>\n<li>\n<div style=\"text-align:justify\"><span style=\"color:#0000ff\"><span style=\"color:#000000\"><span style=\"color:#0000ff\"><span style=\"text-align:justify\">Si une de ces mentions manque ou si le contrat n&rsquo;est pas \u00e9crit, il est suppos\u00e9 \u00eatre un <span style=\"color:#000080\"><em><strong>CDI \u00e0 temps plein<\/strong><\/em><\/span>.<\/p>\n<p style=\"text-align:justify\"><span style=\"color:#0000ff\"><span style=\"color:#000000\">La clause d&rsquo;essai est de dur\u00e9e r\u00e9duite, qu&rsquo;il s&rsquo;agisse d&rsquo;un contrat d&rsquo;ouvrier ou d&#8217;employ\u00e9 : de 7 \u00e0 14 jours.<\/span><\/span><\/p>\n<p style=\"text-align:justify\">Le contrat est r\u00e9dig\u00e9 en deux exemplaires, un pour l&#8217;employeur, un pour l&rsquo;\u00e9tudiant.\u00a0 Si celui-ci est \u00e2g\u00e9 de 18 ans et plus, il peut le signer lui-m\u00eame, sinon, c&rsquo;est son responsable l\u00e9gal (parent ou tuteur) qui peut signer le document.<\/p>\n<p style=\"text-align:justify\">L&#8217;employeur doit faire la d\u00e9claration \u00e9lectronique imm\u00e9diate d&#8217;embauche (Dimona) ou envoyer le contrat dans les 7 jours de la signature \u00e0 l&rsquo;inspection du travail du ressort de l&rsquo;entreprise.<\/p>\n<p style=\"text-align:justify\">L&#8217;employeur doit remettre au travailleur <em><strong>une copie du r\u00e9glement de travail <\/strong><\/em>d\u00e8s l&rsquo;entr\u00e9e en service.<\/p>\n<p style=\"text-align:justify\">Le<em><strong> contrat de travail<\/strong><\/em> est un <em><strong>document social<\/strong><\/em> : le fait de ne pas remplir une de ces obligations entra\u00eene des<em><strong> sanctions pour l&#8217;employeur&#8230;<\/strong><\/em><\/p>\n<h2 style=\"text-align:justify\"><span style=\"color:#000080\"><em><strong>Le temps de travail<\/strong><\/em><\/span><\/h2>\n<p style=\"text-align:justify\">En r\u00e8gle g\u00e9n\u00e9rale, la<em><strong> dur\u00e9e du travail<\/strong><\/em>, dans le secteur priv\u00e9 <em><strong>n&rsquo;exc\u00e9dera pas 38 heures semaines et 8 heures par jour<\/strong><\/em>.\u00a0 En cas de semaine de 5 jours, les \u00e9tudiants de plus de 18 ans peuvent prester jusqu&rsquo;\u00e0 9 heures par jour.\u00a0 Par contre, les \u00e9tudiants de moins de 18 ans ne peuvent travailler plus de 8 heures par jour et ne peuvent effectuer aucune heure suppl\u00e9mentaire.<\/p>\n<p style=\"text-align:justify\">En outre, les \u00e9tudiants ont droit \u00e0 une <em><strong>pause <\/strong><\/em>apr\u00e8s 4 heures de travail pour les moins de 18 ans et apr\u00e8s 6 heures pour les plus de 18 ans.<\/p>\n<p style=\"text-align:justify\">Le<em><strong> temps partiel<\/strong><\/em> n&rsquo;est normalement pas autoris\u00e9 en-dessous de trois heures par jour et un tiers-temps hebdomadaire.<\/p>\n<h2 style=\"text-align:justify\"><span style=\"color:#000080\"><em><strong>La r\u00e9mun\u00e9ration<\/strong><\/em><\/span><\/h2>\n<p style=\"text-align:justify\">La <em><strong>r\u00e9mun\u00e9ration <\/strong><\/em>doit \u00eatre celle pr\u00e9vue par le secteur et \u00e0 d\u00e9faut, au moins \u00e9quivalente au <em><strong>revenu minimum mensuel moyen, <\/strong><\/em><span style=\"color:#000000\">qui varie selon l&rsquo;\u00e2ge.\u00a0 En cas de doute, on peut s&rsquo;informer aupr\u00e8s de l&rsquo;inspection des lois sociales ou de son syndicat&#8230;<\/span><\/p>\n<p style=\"text-align:justify\"><span style=\"color:#000000\">Les \u00e9tudiants qui travaillent ont \u00e9galement droit<em><strong> au paiement des jours f\u00e9ri\u00e9s<\/strong><\/em>.<\/span><\/p>\n<p style=\"text-align:justify\"><span style=\"color:#000000\"><em><strong>Le salaire garanti en cas de maladie varie selon la dur\u00e9e du contrat<\/strong><\/em> :<\/span><\/p>\n<ul>\n<li><span style=\"color:#000000\">pour une occupation de <em><strong>moins de trois mois<\/strong><\/em>, l&#8217;employeur devra verser un s<em><strong>alaire garanti de 14 jours<\/strong><\/em><\/span><\/li>\n<li><span style=\"color:#000000\">pour une occupation de<em><strong> trois mois et plus<\/strong><\/em>, cette obligation passe \u00e0 <em><strong>un mois de salaire garanti<\/strong><\/em><\/span><\/li>\n<\/ul>\n<p>L&rsquo;accident de travail doit \u00eatre couvert par une assurance et l&#8217;employeur doit \u00eatre \u00e0 :<\/p>\n<ul>\n<li>contrat de<em><strong> moins d&rsquo;un mois : <\/strong><\/em>\n<ul>\n<li>pr\u00e9avis de l&rsquo;<em><strong>employeur <\/strong><\/em>: 3 jours<\/li>\n<li>pr\u00e9avis de l&rsquo;<em><strong>\u00e9tudiant <\/strong><\/em>: 1 jours<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li>contrat de<em><strong> plus d&rsquo;un mois<\/strong><\/em> :\n<ul>\n<li>pr\u00e9avis de l&rsquo;<em><strong>employeur <\/strong><\/em>:\u00a0 7 jours<\/li>\n<li>pr\u00e9avis de l&rsquo;<em><strong>\u00e9tudiant <\/strong><\/em>: 3 jours<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2><span style=\"color:#000080\"><em><strong>Les allocations familiales<\/strong><\/em><\/span><\/h2>\n<p>Le travail \u00e9tudiant <em><strong>n&rsquo;a pas d&rsquo;incidence sur les allocations familiales si<\/strong><\/em> :<\/p>\n<ul>\n<li>l&rsquo;activit\u00e9 lucrative a \u00e9t\u00e9 exerc\u00e9e en<em><strong> juillet, ao\u00fbt et septembre<\/strong><\/em><\/li>\n<li>du premier, deuxi\u00e8me et quatri\u00e8me trimestre civil pour autant qu&rsquo;elle<em><strong> ne d\u00e9passe pas 240 heures<\/strong><\/em><\/li>\n<\/ul>\n<p>Par activit\u00e9 lucrative, il faut entendre : toute activit\u00e9 r\u00e9mun\u00e9r\u00e9e dans le cadre d&rsquo;un contrat de travail, d&rsquo;un statut (fonctionnaires) ou d&rsquo;un contrat d&rsquo;ind\u00e9pendant.<\/p>\n<p><em><strong>Attention : pour le ch\u00f4mage, le travail \u00e9tudiant prolonge le stage d&rsquo;attente !<\/strong><\/em><\/p>\n<h2><span style=\"color:#000080\"><em><strong>Et les imp\u00f4ts dans tout \u00e7a ?<\/strong><\/em><\/span><\/h2>\n<p><span style=\"color:#000000\"><strong>Au niveau fiscal, le travail \u00e9tudiat peut avoir des r\u00e9percussions importantes tant sur la situation de l&rsquo;\u00e9tudiant que sur celle de ses parents !<\/strong><\/span><\/p>\n<h3>Quotit\u00e9 du revenu exempt\u00e9e d&rsquo;imp\u00f4t<\/h3>\n<p>Une partie du revenu de l&rsquo;\u00e9tudiant est totalement exempt\u00e9e d&rsquo;imp\u00f4ts :<\/p>\n<ul>\n<li style=\"text-align:justify\">pour les revenus gagn\u00e9s en 2014 (imposables en 2015), cette quotit\u00e9 s&rsquo;\u00e9l\u00e8ve \u00e0\u00a0 : <strong>7.350 euros<\/strong> lorsque le <strong><em>revenu imposabl<\/em><\/strong>e ne d\u00e9passe pas <strong>26.280 euros<\/strong>.\u00a0 Autrement, dit, si vous avez gagn\u00e9
