europ\u00e9ens, vit une crise de l&#8217;emploi des 45 ans et plus.<\/strong><\/span><\/p>\n<p style=\"text-align:justify\"><span style=\"color:#000080\"><strong>Esta <em>Conseil National du Travail<\/em> (CNT) vient de signer une nouvelle <em>Convention Collective de Travail<\/em>.<\/strong><\/span><\/p>\n<p style=\"text-align:justify\"><span style=\"color:#000080\"><strong>Cette Convention impose un \u00ab\u00a0plan pour l&#8217;emploi des travailleurs \u00e2g\u00e9s\u00a0\u00bb aux entreprises de plus de 20 travailleurs.<\/strong><\/span><\/p>\n<p style=\"text-align:justify\">On \u00e9voque souvent, dans les m\u00e9dias, le ch\u00f4mage de jeunes particuli\u00e8rement \u00e9lev\u00e9.\u00a0 Mais on oublie souvent qu&rsquo;une autre cat\u00e9gorie de travailleur rencontre des difficult\u00e9s croissantes pour conserver son job ou pour en retrouver un : les <strong>travailleurs de plus de 45 ans<\/strong>.<\/p>\n<p style=\"text-align:justify\">La Belgique est l&rsquo;un des pays d&rsquo;Europe o\u00f9 le nombre de travailleurs de plus de 45 ans \u00e0 l&#8217;emploi est le plus faible.<\/p>\n<p style=\"text-align:justify\">Les gouvernements successifs ont tent\u00e9 de r\u00e9agir par des conventions d&rsquo;outplacement &#8211; accompagnement des travailleurs concern\u00e9s par des style=\"color:#000080\"><strong>Vous avez dit CNT ?<\/strong><\/span><\/h2>\n<p style=\"text-align:justify\">Esta <strong>CNT<\/strong> &#8211; <em>Conseil National du Travail<\/em> &#8211; est un organisme paritaire.\u00a0 C&rsquo;est-\u00e0-dire qu&rsquo;il rassemble des repr\u00e9sentants du gouvernement, des employeurs et des travailleurs (les syndicats).<\/p>\n<p style=\"text-align:justify\">Il signe r\u00e9guli\u00e8rement des <em>conventions collectives de travail<\/em> (CCT) : ce sont des documents qui sont valables pour le pays entier et qui r\u00e8glent les conditions de travail, d&#8217;embauche, etc.\u00a0\u00a0 Ces conventions sont valables pour une p\u00e9riode d\u00e9termin\u00e9e.<\/p>\n<p style=\"text-align:justify\">La convention collective de travail num\u00e9ro 104 est sign\u00e9e pour une dur\u00e9e de 4 ans, au terme duquel les partenaires sociaux \u00e9valueront son impact.\u00a0 Elle sera ensuite reconduite telle quelle ou \u00ab\u00a0travailleurs \u00e2g\u00e9s\u00a0\u00bb<\/strong><\/span><\/h2>\n<p style=\"text-align:justify\">Cette <a href=\"http:\/\/www.cnt-nar.be\/CCT-ORIG\/cct-104-%2827-06-2012%29.pdf\" target=\"_blank\">convention collective de travail Num\u00e9ro 104 du 27 juillet 2012<\/a> concerne un \u00ab\u00a0<strong>plan pour les travailleurs \u00e2g\u00e9s des entreprises<\/strong>\u00ab\u00a0.\u00a0 Les travailleurs \u00e2g\u00e9s de 45 ans et plus appr\u00e9cieront, au passage, l&rsquo;\u00e9pith\u00e8te qui leur est accol\u00e9e.\u00a0 Avec une esp\u00e9rance de vie qui s&rsquo;allonge chaque ann\u00e9e, 45 ans sera bient\u00f4t l&rsquo;\u00e2ge moyen des Tanguy, ces jeunes qui habitent toujours au domicile des parents&#8230;<\/p>\n<p style=\"text-align:justify\">Ce plan concerne les <strong>travailleurs de plus de 45 ans<\/strong> pour les<strong> entreprises qui comprennent plus de 20 travailleurs \u00e0 temps plein<\/strong>.\u00a0 Les temps partiels et les travailleurs interimaires entrent \u00e9galement en ligne de compte pour le calcul.\u00a0 Ce qui signifie qu&rsquo;une fois de plus, une majorit\u00e9 des PME \u00e9chappe \u00e0 la r\u00e9glementation.<\/p>\n<p style=\"text-align:justify\">Ces plans sont propos\u00e9s pour un an, mais les employeurs peuvent envisager un plan jusqu&rsquo;\u00e0 5 ans, \u00e0 condition de rendre compte chaque ann\u00e9e des mesure mises en oeuvre.<\/p>\n<p style=\"text-align:justify\">Que proposent concr\u00e8tement ces plans ?\u00a0 Toutes les mesures d\u00e9j\u00e0 prises ou que l&rsquo;entreprise envisage de prendre pour les travailleurs concern\u00e9s :<\/p>\n<ol>\n<li>la s\u00e9lection et l&rsquo;engagement de nouveaux travailleurs;<\/li>\n<li>le d\u00e9veloppement des comp\u00e9tences et des qualifications des travailleurs, y compris l&rsquo;acc\u00e8s aux formations;<\/li>\n<li>le d\u00e9veloppement de carri\u00e8re et l&rsquo;accompagnement de carri\u00e8re au sein de l&rsquo;entreprise;<\/li>\n<li>les possibilit\u00e9s d&rsquo;obtenir via mutation interne une fonction adapt\u00e9e \u00e0 l&rsquo;\u00e9volution des facult\u00e9s et des comp\u00e9tences du travailleurs;<\/li>\n<li>les possibilit\u00e9s d&rsquo;adapter le temps de travail et les conditions de travail;<\/li>\n<li>la sant\u00e9 du travailleur, la pr\u00e9vention et la possibilit\u00e9 de rem\u00e9dier aux obstacles physiques et psycho-sociaux entravant le maintien au travail;<\/li>\n<li>les syst\u00e8mes de height=\"375\" \/><\/a><\/h4>\n<p style=\"text-align:justify\">L&#8217;employeur peut s\u00e9lectionner un seul de ces domaines d&rsquo;action ou m\u00eame en choisir un en dehors de cette liste.\u00a0 C&rsquo;est dire si le flou r\u00e8gne en la mati\u00e8re et si les employeurs belges &#8211; bien connus pour leur inventivit\u00e9 lorsqu&rsquo;il s&rsquo;agit d&rsquo;\u00e9chapper aux r\u00e8gles &#8211; vont pouvoir faire preuve de cr\u00e9ativit\u00e9.<\/p>\n<p style=\"text-align:justify\">La convention pr\u00e9voit un certain contr\u00f4le : \u00ab\u00a0<em>l&#8217;employeur conserve le plan pour l&#8217;emploi pendant cinq ans et le tient \u00e0 la disposition des autorit\u00e9s comp\u00e9tentes. Il leur est communiqu\u00e9 sur simple demande<\/em>.\u00a0\u00bb<\/p>\n<p style=\"text-align:justify\">Par contre, sauf erreur de ma part, je ne vois aucune sanction pr\u00e9vue, ce qui laisse pr\u00e9sager de l&rsquo;usage que certains employeurs feront de ce document&#8230;<\/p>\n<h2 style=\"text-align:justify\"><span style=\"color:#000080\"><strong>Le co\u00fbt de l&rsquo;exp\u00e9rience et des pr\u00e9jug\u00e9s<\/strong><\/span><\/h2>\n<p style=\"text-align:justify\">Pour avoir mis en place un dispositif de ce type en Belgique il y a quelques ann\u00e9es, je peux t\u00e9moigner de la difficult\u00e9 de cette tranche d&rsquo;\u00e2ge \u00e0 retrouver un \u00ab\u00a0<em>emploi d\u00e9cent<\/em>\u00ab\u00a0, voire un emploi tout court&#8230;<\/p>\n<p style=\"text-align:justify\">Les r\u00e9ponses du type \u00ab\u00a0vous avez trop d&rsquo;exp\u00e9rience\u00a0\u00bb poussent comme des champignons.\u00a0 Trop d&rsquo;exp\u00e9rience ?\u00a0 Depuis quand peut-on avoir trop d&rsquo;exp\u00e9rience pour effectuer son travail correctement ?<\/p>\n<p style=\"text-align:justify\">Non, derri\u00e8re l&rsquo;hypocrisie de ces r\u00e9ponses, se cache le vrai probl\u00e8me :\u00a0 l&rsquo;exp\u00e9rience co\u00fbte cher et les pr\u00e9jug\u00e9s anti-vieux ont la peau dure.\u00a0 Ils seraient plus lents, moins dociles, moins ouverts aux nouvelles technologies.<\/p>\n<p style=\"text-align:justify\">S&rsquo;il est possible que des personnes de plus de 45 ans ne se passionnent pas forc\u00e9ment pour la derni\u00e8re version de la tablette Andro\u00efd de chez Truc, nombre d&rsquo;entre elles s&rsquo;impliquent vraiment dans leur travail.<\/p>\n<p style=\"text-align:justify\">En outre, cette exp\u00e9rience qui co\u00fbte si cher est irrempla\u00e7able.\u00a0 Dans des situations de crise, c&rsquo;est souvent cette exp\u00e9rience qui permet de prendre rapidement de bonnes d\u00e9cisions que les jeunes loups &#8211; \u00e0 peine sortis de l&rsquo;\u00e9cole et la t\u00eate encore farcie des th\u00e9ories \u00e9conomiques en vogue &#8211; ne soup\u00e7onneront m\u00eame pas&#8230;<\/p>\n<p style=\"text-align:justify\">Ce sont ces m\u00eames personnes qui peuvent transmettre un savoir-faire pr\u00e9cieux dans les ateliers, les bureaux, daus les routes pour les services de vente, etc.<\/p>\n<p style=\"text-align:justify\">Dans les toute prochaines ann\u00e9es, cette absence de transmission du savoir et du savoir-faire pourrait bien se traduire en co\u00fbt \u00e9lev\u00e9 et en pertes dramatiques pour certaines entreprises qui \u00ab\u00a0<em>d\u00e9graissent<\/em>\u00a0\u00bb massivement.<\/p>\n<p style=\"text-align:center\"><span style=\"color:#000080\"><strong>Vous avez aim\u00e9 cet article ?\u00a0 Inscrivez-vous \u00e0 <\/strong><\/span><span style=\"color:#3366ff\"><strong><a title=\"Inscription newsletter Marco Bertolini - Conseil et formation\" href=\"http:\/\/eepurl.com\/tOqA1\"><span style=\"color:#3366ff\">ma newsletter<\/span><\/a><\/strong><span style=\"color:#000080\"><strong> et ne ratez plus aucun article ou \u00e9v\u00e9n\u00e9ment !<\/strong><\/span><\/span><\/p>","protected":false},"excerpt":{"rendered":"<p>La Belgique, comme de nombreux pays europ\u00e9ens, vit une crise de l&#8217;emploi des 45 ans et plus.
